Terms and Conditions Villa 4 Rent Curaçao / Villa Kaya Menta

These Terms and Conditions apply to all reservations and rentals of the holiday accommodation Villa Kaya Menta (“Owner”), regardless of name, location, or type of service. By making a reservation, the tenant agrees to these terms and conditions.

The Owner
The owner is the proprietor of the rented accommodation and appoints a manager who acts as the contact person during the stay.

The Tenant
The tenant is the natural person under whose name the reservation was made, as well as the other guests included in the reservation.

  • The tenant must be at least 23 years old. Younger guests must be accompanied by a parent or legal guardian.

  • The tenant is at all times responsible for the behavior and safety of all guests and visitors.

  • The owner provides the tenant with house and resort rules which the tenant and their party must follow.

Payment and Payment Terms

  • After making a reservation, the tenant will receive an invoice for a 40% deposit of the rental amount. Payment within 7 days confirms the reservation.

  • The remaining balance (60%) must be paid no later than 6 weeks before arrival. Failure to pay on time may result in cancellation of the reservation without refund.

Security Deposit

  • The security deposit must be paid together with the final 60% of the rental payment (€500 for up to 14 days, with a 25% increase for each additional week).

  • The security deposit will be used to cover any damage, excessive cleaning, and water and electricity usage.

  • The main tenant is jointly and severally liable for all damage.

Utility Costs

  • Water and electricity are not included in the rental price.

  • Actual consumption will be measured and deducted from the security deposit after checkout.

Changes and Cancellations

  • The tenant may make one reservation change free of charge; subsequent changes cost €25 each.

  • If a reservation is canceled, the tenant is liable for the reservation and administration fee (€75), plus the following cancellation costs:

    • A: Cancellation up to 42 days before arrival: 40% deposit of the rental amount.

    • B: Cancellation from the 42nd day (inclusive) until the day of arrival: 100% of the rental amount.

  • No refund will be provided for early departure.

  • The owner may cancel due to uninhabitability of the property, serious damage, or force majeure; amounts already paid will be refunded within 7 days.

Arrival and Departure

  • Check-in from 16:00, check-out by 11:00 unless otherwise agreed.

  • The tenant must provide flight numbers and times in advance.

  • Upon arrival, the property will be inspected together with the manager. Any defects must be reported on-site.

Tenant Liability

  • The tenant is responsible for any damage to the property, garden, pool, and furnishings.

  • Damage due to negligence or improper use will be fully charged to the tenant.

  • Blockages caused by improper objects in toilets or damage to the septic tank due to misuse are the tenant’s responsibility.

Owner Liability
The owner is not liable for:

  • Theft, loss, or damage to property.

  • Accidents in and around the accommodation.

  • Malfunctions of equipment, electricity, or water.

  • Force majeure, natural disasters, or construction activities outside the rented property.

  • The tenant acknowledges the inherent risks of using the accommodation and its facilities.

Hygiene, Cleaning, and Pest Control

  • The accommodation is delivered clean.

  • The tenant must keep the property and garden clean; garbage must be disposed of on designated days.

  • Pest control costs caused by tenant negligence will be charged to the tenant.

  • Preventive pest control measures performed by the owner are structural; structural problems cannot be claimed as damage.

Linen and Bedding

  • Bed, bath, and kitchen linen are provided. For bookings of 10 nights or more (or multiples thereof), a mid-stay cleaning and linen change is mandatory.

Basic House Rules

  • No pets allowed.

  • No parties or events without written permission.

  • No commercial activities may be conducted on or around the property.

  • Smoking is prohibited inside; outdoor smoking is allowed following fire safety guidelines.

  • Furniture may not be placed outside or on the beach.

  • Furniture may not be moved to a location outside the rented property.

  • Noise after 22:00 is prohibited; repeated disturbances may lead to eviction without refund.

Events, Photography, and Filming

  • Commercial photography, filming, or events are prohibited without prior permission.

Extra Services

  • Optional services such as car rental, BBQ service, transfers, or groceries are separate from the rental agreement and these terms.

Acceptance Upon Arrival

  • By accepting the accommodation at arrival, the tenant acknowledges that it was found in good condition.

  • Any complaints must be reported on-site; complaints after departure do not qualify for compensation.

Force Majeure

  • Includes pandemics, epidemics, government measures, extreme weather, road closures, strikes, or other situations beyond the owner’s control.

  • The owner is not liable for inconvenience or cancellations caused by force majeure.

Security and Personal Belongings

  • Personal belongings are at the tenant’s own risk.

  • A safe is provided, but loss or theft remains the tenant’s responsibility.

Communication and Complaints

  • Complaints must be reported immediately in writing to the manager and owner.

  • Complaints reported after the stay cannot justify any claim for compensation.

Notice of Terms and Conditions

  • These Terms and Conditions are publicly available at villa4rentcuracao.com and available upon request.

  • By confirming the reservation, the tenant agrees to all provisions.

Excessive Disturbance / Immediate Termination of Rental

  • The tenant must behave as a good neighbor at all times and avoid causing nuisance.

  • In case of repeated or serious disturbances (noise, dangerous behavior, or disruption), the owner reserves the right to terminate the rental immediately without refund.

  • Any damage or costs resulting from such behavior are the tenant’s responsibility.

Additional Insurance or Coverage

  • The tenant is strongly advised to take out travel and/or cancellation insurance for unforeseen circumstances.

  • The owner is not liable for costs, damage, or losses due to lack of insurance.

  • It is the tenant’s responsibility to ensure coverage for the entire stay and activities.

Additional Provisions

  • If any part of these Terms and Conditions is invalid, all other provisions remain in force.

  • The tenant agrees that non-compliance with these Terms and Conditions may result in termination of the stay without refund.
